Federal Fair Labor Standards Act (FLSA)
- Overtime triggers strictly after 40 regular hours in a single 7-day workweek.
- Daily shifts of 10, 12, or 14 hours do NOT trigger daily overtime if total weekly hours remain under 40.
- Overtime rate is calculated at 1.5× the non-exempt employee's regular rate of pay.
- Bi-weekly averaging is prohibited: each 7-day workweek stands alone.
California Labor Code (Section 510)
- Daily Overtime (1.5×): Applies to hours worked over 8 up to 12 in a single workday.
- Daily Double Time (2.0×): Applies to all hours worked beyond 12 in a single workday.
